MPU for drugs: starting proof of abstinence correctly (checklist)

File inspection, accredited laboratory, tests without gaps: with this checklist you can start drug proof of abstinence for the MPU without costly mistakes.

You start proof of abstinence (Abstinenznachweis) from drugs for the MPU (medical-psychological assessment, Medizinisch-Psychologische Untersuchung) correctly by first using file inspection (Akteneinsicht) to clarify what is required, and then immediately registering with a laboratory accredited to DIN EN ISO/IEC 17025. After that, you must see the programme through without gaps, with unannounced urine tests or hair analyses. The most common and most expensive mistake is starting too late or in a formally incorrect way.

Why is proof of abstinence so decisive for drugs?

In a drug MPU, proof of abstinence is usually a prerequisite for a positive expert report (Gutachten). With hard drugs such as cocaine, amphetamine or opiates, under § 14 FeV (Driving Licence Regulation, Fahrerlaubnis-Verordnung) even a single use can rule out fitness to drive, even without driving. Getting the licence back (Wiedererteilung) is then usually only possible with proof of abstinence and an MPU.

How long you have to provide proof depends on how the assessors classify your case. The assessment criteria (Beurteilungskriterien) distinguish three groups:

ClassificationDescriptionTypical length of abstinence
D1 – dependenceDaily life revolves around the substanceTherapy + 12 months
D2 – misuseadvanced, multiple substances or hard drugs12 months
D3 – riskwithout signs of an advanced problemoften 6 months are sufficient

Cannabis has its own classification system under § 13a FeV. If there is cannabis dependence, fitness to drive is only restored after 1 year of proven abstinence. You can find an overview of all drug case groups on the page MPU for drugs.

Which checklist helps you get started?

The following checklist covers the points that must be clarified before and immediately after the start. Work through them in this order.

  1. Request file inspection: clarify whether 6 or 12 months are required and which substances have to be tested for. Without this information, you are planning blind. The guide File inspection at the driving licence authority explains how to do this.
  2. Choose an accredited laboratory: the laboratory must be accredited to DIN EN ISO/IEC 17025 (forensic toxicology).
  3. Check recognition: ask beforehand whether the assessment centre (Begutachtungsstelle) recognises the programme. Proof that does not meet the CTU criteria (chemical-toxicological analysis, Chemisch-Toxikologische Untersuchung) is worthless.
  4. Decide on the method: urine screening, hair analysis or a combination – suited to the substance and the period.
  5. Register immediately: every day you wait pushes your MPU appointment back.
  6. Make sure you are reachable: for urine tests, you are summoned without notice and usually have to give a sample within ~24 hours.
  7. Always carry your ID: an identity check and a supervised sample are mandatory.
  8. Collect all results: keep every result in the original; you will need all of them for the MPU.

This checklist is a guide. What is binding are your authority's order and your laboratory's requirements.

Urine or hair – which method suits you?

Urine screenings and hair analyses are both options for proof of abstinence from drugs. Both are recognised if they meet the CTU criteria.

Urine screening

Urine screening tests for classes of substances. Appointments are unannounced, and the sample is given under supervision. The usual numbers are 4 tests for 6 months and 6 tests for 12 months.

Hair analysis

Hair analysis detects drug use retrospectively over a longer period. It can be used on its own or together with urine tests. Clarify before you start what hair length and how many samples your laboratory needs.

The page Proof of abstinence shows which forms of proof there are and how they work.

Which mistakes do many people make at the start?

Most mistakes do not happen during the programme but before and shortly after it starts. They almost always cost months.

  • Starting too late: many people wait for the MPU order or the end of the ban period (Sperrfrist). Yet the evidence period is usually the bottleneck of the whole plan.
  • Wrong laboratory: a non-accredited laboratory or a programme that the assessment centre does not recognise makes the entire proof worthless.
  • Missing an appointment: a missed appointment can invalidate the whole programme. The abstinence clock then usually starts again.
  • Self-organised tests: tests without an unannounced summons, without supervision and without complete documentation do not count.
  • Starting too early without seeing it through: a relapse is not the end, but it pushes back the timetable. Start when you are really ready – but do not put it off.
  • Bought proof: „ready-made“ proof, clean results for money or backdated programmes are forgery of documents (Urkundenfälschung).

What does a realistic timetable look like?

A realistic timetable is based on the required length of abstinence of 6 or 12 months, because this determines the earliest MPU date. Preparation runs in parallel.

  1. Immediately: request file inspection, choose a laboratory, clarify recognition.
  2. Straight afterwards: register for the programme, first test.
  3. In parallel during abstinence: preparation for the psychological interview. Typically 10 to 12 sessions of 60 minutes each, usually once a week over 2 to 3 months.
  4. In the case of a court-imposed ban: apply early for the reissue of your licence (Neuerteilung), about 3 months before the end of the ban period. You can find more on deadlines on the page MPU deadlines.
  5. After the end of the evidence period: MPU at a freely chosen, officially recognised assessment centre.

The proof must be complete *before* the MPU. If you only start once the order arrives, you often lose 6 to 12 months.

What counts in the interview in addition to the proof?

Proof of abstinence alone is not enough; the psychological interview is also decisive. The assessor checks whether you have understood why you used drugs, what has specifically changed since then and why the change is stable.

Your proof is an important piece of evidence of the change in behaviour. It must match your account, the questionnaire and the file. Contradictions stand out immediately.

For a positive expert report you usually need three pillars: insight into the problem, i.e. the causes of your drug use, a concrete change in behaviour (for example new social circles, strategies for risky situations) and stability with a sustainable inner motive. Abstinence is the evidence; you have to make the pillars credible yourself in the interview.

What you can do now

  1. Request file inspection today from your driving licence authority (Führerscheinstelle).
  2. Research accredited laboratories (DIN EN ISO/IEC 17025) near you and ask about recognition by the assessment centre.
  3. Register as soon as the period and substances are clear – not only after the MPU order.
  4. Plan your daily life so that you can attend short-notice appointments within about 24 hours.
  5. For interview preparation alongside abstinence: find suitable preparation.

Frequently asked questions

Do I have to wait until the MPU has been ordered before I start abstinence?

No, quite the opposite. The evidence period is usually the bottleneck, so you should start as early as possible. Use file inspection beforehand to clarify which duration and substances are required.

Are drug tests from my GP sufficient as proof?

As a rule, no. Only proof according to the CTU criteria is recognised: accredited laboratory, unannounced appointments, identity check and complete documentation.

What happens if I miss a test appointment?

A missed appointment can invalidate the entire programme, and the abstinence clock then usually starts again. So make sure you are reachable at short notice.

How many urine tests do I need?

The usual numbers are 4 tests for 6 months and 6 tests for 12 months. Your programme sets the exact schedule.
