In short
Coercion (Nötigung) in road traffic, for example by tailgating or brake-checking, can lead to an MPU (medical-psychological assessment) if the authority concludes from it that you have a high potential for aggression. An insult (Beleidigung) alone does not automatically lead to an MPU, but together with other incidents it can give rise to doubts about your fitness. What always matters is the individual case and the question in your order. The page MPU because of criminal offences gives an overview of all offences.
When does coercion in road traffic lead to an MPU?
Coercion in road traffic leads to an MPU if the driving licence authority (Fahrerlaubnisbehörde) sees it as a serious criminal offence or as an indication of a high potential for aggression. The legal basis is § 11 Abs. 3 FeV (Driving Licence Regulation, Fahrerlaubnis-Verordnung), which expressly allows the MPU for certain violations and criminal offences.
| § 11 Abs. 3 FeV | Reason | Example in traffic |
|---|---|---|
| No. 4 | Serious violation or repeated violations of traffic regulations | Repeated tailgating with points |
| No. 5 | Serious criminal offence or criminal offences in connection with road traffic | Coercion by brake-checking |
| No. 6 | Serious criminal offence in connection with fitness to drive, especially with a high potential for aggression or using a vehicle | Harassing another person with the car |
| No. 7 | Criminal offences in connection with fitness to drive, especially with a high potential for aggression | Several incidents involving threats or physical violence |
| No. 9 b | Reissue (Neuerteilung) after withdrawal for one of the reasons in No. 4 to 7 | Application after the ban period (Sperrfrist) |
Under § 240 StGB (Criminal Code), a person commits coercion if they unlawfully force another person to act in a certain way by force or by threatening serious harm. Typical examples in traffic are tailgating, brake-checking and harassing others. The penalty is up to 3 years' imprisonment or a fine.
Can an insult also lead to an MPU?
An insult can contribute to an MPU, but on its own it is not an automatic trigger. Insult (§ 185 StGB) is punishable by imprisonment of up to 1 year or a fine, and up to 2 years if committed by means of physical assault.
For the authority, what counts is not the offence as such but whether the act provides indications of a high potential for aggression. A single swear word carries different weight from an insult with physical assault or a series of incidents. Whether an order is issued in your case is decided by the authority in the individual case.
The principle of behaviour transfer (Verhaltenstransfer) is important: offences outside road traffic can count too. The authority assumes that problematic patterns such as impulsiveness or weak commitment to rules can also show behind the wheel.
What consequences do these offences have for your licence and points?
Besides the penalty, coercion and insult can also have consequences for your driving licence. Exactly which ones depends on the judgment and your history.
- Driving ban: for a criminal offence, the court can impose a driving ban of 1 to 6 months (§ 44 StGB), in some circumstances even if the offence was not committed while driving.
- Withdrawal: if an offence committed while driving a motor vehicle shows that you are unfit, the court withdraws the driving licence and sets a ban of 6 months to 5 years (§§ 69, 69a StGB).
- Points: a criminal offence without withdrawal brings 2 points, a criminal offence with withdrawal 3 points.
- Deletion: the entries remain usable for 5 years (without withdrawal) or 10 years (with withdrawal).
Note: Only a specialist lawyer for traffic law (Fachanwalt für Verkehrsrecht) or criminal law can judge whether a penalty order or judgment can be challenged and what consequences you face. This page is not legal advice.
What does the assessor check with aggression offences?
With aggression offences, the assessor checks whether you have understood the pattern behind the offence and deal with anger and conflict differently today. A formula of regret is not enough; what is required is a fundamental, stable change in behaviour.
The assessment criteria assign such cases to hypotheses V1 to V3. V3 is about a change in attitude and insight into risk, V2 about entrenched patterns for which you have to recognise your personal share. With V1, for example with serious, repeated violations, a therapeutically supported process of change over a longer period is needed. More on this in the guide MPU hypotheses explained.
Typical questions in the interview are:
- What exactly happened in the situation, and what did you think and feel at that moment?
- Were there earlier situations in which you reacted in a similar way?
- What did your behaviour „achieve“ for you back then, for example releasing pressure or getting your way?
- How do others notice today that you deal with conflict more calmly?
- What do you do in concrete terms when someone provokes you in traffic?
Typical mistakes are blaming the other road user, trivialising („it was only a word“) and vague resolutions such as „from now on I will stay calm“. What convinces are concrete examples from your everyday life that show the change is already being lived.
Why does a course under § 70 FeV not help here?
With aggression offences, a course under § 70 FeV does not help as a substitute for a new MPU, because § 11 Abs. 10 FeV expressly rules this out. If the MPU was ordered under § 11 Abs. 3 Nr. 4 to 7 FeV, a course certificate is not enough to prove that your fitness has been restored.
For you, this means: your preparation has to be right the first time. Plan more time rather than less, especially if there were several incidents. With repeated offences, traffic therapy is often the right framework, typically 10–12 sessions of 60 minutes over 2–3 months. More on the forms of preparation under MPU preparation.
How do you prepare step by step?
Preparation (Vorbereitung) for an MPU because of coercion or insult follows a clear sequence. Proof of abstinence (Abstinenznachweis) is usually not needed here, unless alcohol or drugs played a role.
- File inspection (Akteneinsicht): read all incidents, witness statements and the question. The assessor knows the file in detail.
- Sort the incidents: write down all situations, including minor ones, and look for common factors such as time pressure, stress or feeling slighted.
- Understand the causes: what function did the aggressive behaviour have for you?
- Build strategies: concrete ways in which you release anger and defuse conflicts today.
- Test the change: over several weeks, collect concrete experiences that you can describe in the interview.
- Practise the interview: in your own words, without model answers.
The fee for the expert report (Gutachten) for criminal offences is about €500–700 (guide value 2026).
What you can do now
- Have the penalty order or judgment checked by a specialist lawyer while deadlines are still running.
- If an MPU is ordered, apply for file inspection immediately and note down the question.
- Write an honest chronology of all conflict situations, in and outside traffic.
- If there have been repeated incidents, plan for longer support, because a § 70 course will not help later.
- Get qualified support: find suitable preparation.
Frequently asked questions
Is tailgating on the motorway coercion?
Tailgating can be coercion under § 240 StGB if you use it to unlawfully force another person to act in a certain way. Whether the offence is made out depends on the individual case. In addition, keeping too short a distance can be punished as an administrative offence with 1 to 2 points.
Will I get an MPU for giving someone the middle finger?
A single insult does not automatically lead to an MPU. The authority checks whether there are indications of a high potential for aggression. If several incidents or physical assaults come together, the risk of an order increases.
Do criminal offences outside road traffic count for the MPU?
Yes, according to the principle of behaviour transfer, offences outside traffic such as bodily harm can also count. The authority assumes that aggressive patterns also show when driving. § 11 Abs. 3 Nr. 6 and 7 FeV expressly name criminal offences connected with fitness to drive.
Do I need proof of abstinence for an MPU because of coercion?
As a rule no, because it is about behaviour and attitude. It is different if alcohol or drugs played a role in the offences. The question can then also cover your consumption behaviour.
